SERVICE AND USAGE AGREEMENT
This Agreement governs the terms under which İyibirNet Internet Technologies (hereinafter “İyibirNet”) provides services via its website www.iyibir.net. By obtaining any service from www.iyibir.net you acknowledge and accept all terms set forth herein. İyibirNet, its content contributors, employees and authorized representatives shall have no legal or criminal liability for any material or moral damages arising from your failure to read or comply with these terms.
İyibirNet reserves the right to update or modify this Agreement unilaterally at any time without prior notice.
All information, statistics, evaluations and content on www.iyibir.net have been compiled from sources deemed reliable under general industry standards; their accuracy and sufficiency are not guaranteed by İyibirNet. İyibirNet shall not be liable for any direct or indirect material, moral or other damages or expenses arising from the use of such content.
By obtaining services from İyibirNet, you are deemed to have read and accepted all warnings and declarations contained in this Agreement. In any dispute or claim, the statements displayed on this website and İyibirNet’s computer records shall be presented as the sole and conclusive evidence.
1.1. Once your order passes fraud checks and payment is received, your account will be created and access details sent to you.
1.2. Payments by credit card or PayPal trigger automatic setup of domain, web hosting and reseller hosting accounts; however, in case of any issue setup may take up to 48 hours.
1.3. Payments by bank transfer or EFT require up to 2 business days for account setup. For VDS and dedicated server services, unless otherwise specified, setup time is up to 48 hours. Software and license deliveries are completed within one week unless stated otherwise in writing or verbally. If delivery is not made within the specified time, İyibirNet is obliged to refund your payment upon request.
1.4. You are responsible for providing and maintaining a valid, active e‑mail address at order time. All communications will be sent to that address. Any damage arising from undelivered or unread e‑mails is your sole responsibility.
1.5. All information provided in registration or order forms must be accurate and complete. İyibirNet reserves the right to refuse full or partial refunds for orders cancelled due to inaccurate information.
1.6. For security purposes, İyibirNet may request a copy of your credit card or identity document. Failure to provide these may result in order cancellation or suspension of services. In cases of suspected fraud, accounts may be suspended and refunds withheld at İyibirNet’s discretion.
Where site migration is included in your package, İyibirNet will make best efforts to migrate your site. However, because configurations vary between providers, no guarantee is given regarding migration success or duration. İyibirNet bears no liability for migration errors or failures.
2.1. All services are governed by the Constitution of the Republic of Turkey and applicable laws.
2.2. You may not hold İyibirNet legally responsible for actions you take using its services; you bear all legal liability for your own actions.
2.3. Hosting unauthorized copyrighted material (music, books, photos, etc.), pornographic/erotic content, or hacking tools is prohibited. Any violation will result in removal of content, access restrictions, suspension or termination of services without refund. Complaints may be submitted to abuse@iyibir.net; İyibirNet may request further information.
2.4. In cases where İyibirNet cannot verify a complaint’s validity or whether an act constitutes a crime, services may not be terminated; you must pursue remedies against the third party directly. İyibirNet is not liable for any resulting damages.
2.5. Services are provided for authorized uses only. If you gain access to unauthorized content or services, you must notify İyibirNet before use, or you assume sole liability for any resulting damages.
2.6. İyibirNet may monitor, record, copy or use content and access logs for legal compliance, system administration, unauthorized access detection, security verification and operational integrity. No other use or sharing shall occur.
2.7. İyibirNet may accept or refuse service to any user. It may warn, remove or block content deemed contrary to the Agreement, illegal, inflammatory or otherwise objectionable, without refund or partial refund.
2.8. Illegal content will be reported to relevant authorities.
2.9. Uploading virus‑infected files or shell scripts may result in immediate account termination without refund; you are liable for any damages to İyibirNet or third parties.
2.10. You are responsible for the security of any software/scripts uploaded and for correct directory permissions. İyibirNet may suspend or terminate services without refund if malicious software is detected.
2.11. İyibirNet reserves the right to require modification of any website, database, account or other materials or settings.
3.1. Unsolicited bulk e‑mail (spam) is strictly prohibited. Violation may result in termination of services with or without notice.
3.2. Any service causing İyibirNet’s IP ranges to be blacklisted will be terminated immediately without notice.
3.3. You agree to pay all costs incurred to delist blacklisted IPs without objection.
4.1. You agree to pay all fees for services on time. Unless you cancel, services renew automatically and invoices are issued.
4.2. To avoid renewal, you must cancel at least 15 days before your service expiration; otherwise it will renew for the next period.
4.3. Cancellation must be made via your customer control panel. İyibirNet reserves the right to collect fees for any service not cancelled within the 15‑day window.
4.4. You are responsible for keeping payment information current and for paying invoices on time. For web and reseller hosting, unpaid invoices incur a 6‑day grace period after which services are suspended; if still unpaid after 30 days, accounts are terminated. For domains, VDS and dedicated servers, non‑payment on the due date results in immediate termination. İyibirNet is not liable for any resulting data loss or damages.
4.5. Overpayments are credited to your account and not refunded; they may be used for future services.
4.6. İyibirNet reserves the right to change prices at any time without notice.
4.7. Usage beyond purchased limits (disk, bandwidth, etc.) will incur additional charges; failure to pay will result in account termination without refund.
4.8. You are liable for all losses arising from chargebacks, disputes or fraudulent payment reversals.
You are solely responsible for your data backups. İyibirNet provides backup services as a courtesy and gives no guarantee of their completeness or availability. İyibirNet is not liable for any data loss.
6.1. İyibirNet may suspend or terminate services at any time, with or without notice, and may refuse full or partial refunds.
6.2. Abusive or insulting behavior toward any İyibirNet staff will result in immediate termination without refund.
6.3. You agree not to publish any statements or conduct that damage İyibirNet’s reputation; violation may incur damages and you submit to jurisdiction of Istanbul courts and enforcement offices.
6.4. Any attacks, excessive load or other acts harming İyibirNet’s servers may result in termination without refund and you are liable for any damages.
6.5. No refunds for termination prior to expiration (whether due to breach or user request); unused time credits may be applied to future services but will not be refunded.
Bulk or spam e‑mail is prohibited.
CPU or memory usage exceeding 25% for more than 90 seconds is prohibited.
Average daily resource usage must not exceed 5% for web hosting and 12% for reseller hosting.
Server‑based programs (IRCd, etc.), spiders/indexers (Google Cash/AdSpy, etc.), IRC clients, proxies, BitTorrent/P2P, game servers (Counter‑Strike, Half‑Life, etc.), cron jobs running more frequently than every 15 minutes, and file‑sharing applications are forbidden.
Each web hosting account is limited to 250,000 files; accounts with more than 100,000 files may not be backed up.
Bulk or spam e‑mail is prohibited.
Excessive disk I/O affecting other VDS instances is prohibited.
Proxies, BitTorrent/P2P, and game servers are forbidden.
Customers creating excessive or unnecessary backups may have services suspended or terminated without notice.
Unlimited plans cover website file hosting and traffic only.
They may not be used for generic storage or backup purposes.
Your package includes a monthly traffic allowance. Exceeding this limit may result in suspension until the next billing cycle or purchase of additional traffic. Unused traffic does not roll over. Over‑usage charges will be invoiced and are payable without objection.
İyibirNet guarantees 99% uptime. Failure to meet this guarantee entitles you to one month of free service for the affected package upon request. Third‑party monitoring reports are not valid; İyibirNet’s records govern. Claims must be submitted to bilgi@iyibir.net. For VDS and dedicated servers, only network uptime is guaranteed and only upon your notification. This guarantee excludes scheduled maintenance and attacks by malicious third parties. License fees are not covered by any credit.
Support is limited to services you have purchased. İyibirNet does not provide software support or perform user‑level tasks (e‑mail configuration, database creation, etc.) outside initial system deployment. VDS and dedicated server support covers return to delivered state only. Software services are guaranteed to function at delivery. All support requests must be made via the customer panel; no support is provided through e‑mail, phone, live chat or contact form.
“24/7 support” does not imply instant response; it means support is available outside regular business hours. Responses are typically provided within 24 hours, barring exceptional circumstances.
Reseller hosting customers assume responsibility for supporting their own end users. İyibirNet may suspend reseller accounts if their customers contact İyibirNet directly until the reseller addresses the issue. You bear full liability for any illegal or non‑compliant content hosted by your customers.
İyibirNet reserves the right to reset VDS or dedicated server passwords. You are responsible for maintaining a valid e‑mail address and root password in our system. No backups are made by İyibirNet; all data and backup responsibilities lie with you.
İyibirNet may reset passwords for co‑located servers. You must maintain valid e‑mail and root credentials. Equipment may be held as collateral for unpaid fees, including legal interest, until payment is made.
No additional fees will be charged during your prepaid service term unless you purchase add‑ons or exceed your usage limits. İyibirNet reserves the right to change prices and renew at new rates upon term expiration.
15.a. You agree not to harm İyibirNet; you will indemnify İyibirNet for any material or moral damages you cause.
15.b. You agree not to impose any legal liabilities on İyibirNet; you will cover all court and attorney fees arising from claims against İyibirNet.
İyibirNet shall not be liable for any damages to your business. All services are provided “as is” without warranty of any kind, including data loss, delays, interruptions or inaccurate delivery. İyibirNet disclaims liability for data breaches resulting from hacking.
İyibirNet is obliged to provide any requested information, including personal data, to legal authorities when legally required.
